ARTICLE I

Parking Restrictions

 

§ 222‑1. Parking of vehicles prohibited at certain times. It shall be unlawful between November 1 and April 15 next ensuing in each year hereafter for anyone to leave any motor vehicle, trailer or other vehicle parked or standing upon any portion of a public highway within the Town of Blooming Grove outside of villages and state highways maintained by the state, unless such vehicle is attended by a person legally capable of operating such vehicle.

§ 222‑2. Parking prohibited in designated locations. [Added 11‑13‑1994 by L.L. No. 5‑19841The parking of vehicles is hereby prohibited in any of the following locations:

A.  On both sides of Orange Road and Rockland Road from the Town of Monroe boundary to the intersection of Old Museum Village Road.

B. On both sides of Lee Avenue. [Added 4‑14‑1986 by L.L. No. 1‑19861

C.  On and in the area located between State Route No. 208 and Clove Road and northerly of the intersection of those two roads. [Added 2‑26‑1996 by L.L. No. 1‑19961

ARTICLE II

Removal and Storage of Vehicles

 

§ 222‑3. Authority to impound vehicles.

 

A.  When any vehicle is parked or abandoned on any highway within this town outside of any incorporated village during a snowstorm, flood, fire or other public emergency which affects that portion of the public highway upon which said vehicle is parked or

abandoned, said vehicle may be removed by the Town Highway Superintendent or any Town Constable.

B. When any vehicle is found unattended on any highway within this town outside of any incorporated village where said vehicle constitutes an obstruction to traffic, said vehicle may be removed by the Town Highway Superintendent or any Town Constable.

C. When any vehicle is parked or abandoned on any highway within this town outside of any incorporated village where stopping, standing or parking is prohibited, said vehicle may be removed by the Town Highway Superintendent or any Town Constable.

 

§ 222‑4. Storage and charges.

 

After removal of any vehicle as provided in this article, the Town Highway Superintendent or any Town Constable may store such vehicle in a suitable place at the expense of the owner. Such owner, or person in charge of the vehicle, may redeem the same upon payment to the Town Clerk of the amount of all expenses actually and necessarily incurred in effecting such removal. Removal charges shall not exceed $25 and storage charges shall not exceed $2 per day or fraction thereof.

 

§ 222‑5. Notice of removal.

 

The Town Highway Superintendent or any Town Constable shall without delay report the removal and the disposition of any vehicle removed as provided in this article to the Town Clerk and it shall be the duty of such Town Clerk to ascertain to the extent possible the owner of the vehicle or person having same in charge and notify him of the removal and disposition of such vehicle and of the amount which will be required to redeem same.

ARTICLE III

Stone Gate Apartments

§ 222‑6. Purpose.

 

This article is adopted pursuant to Vehicle and Traffic Law § 1660‑a to regulate traffic and vehicles with respect to the parking areas and private streets and roadways of a private apartment house complex known as "Stone Gate Garden Apartments" and shown on the Tax Maps as Section No. 45, Block No. 1, Lot Nos. 11.211, 11.212, 11.213, 11.214, 11.230, 11.240 and 11.250.

 

§ 222‑7. Maximum speed limits.

 

Twenty miles per hour is hereby established as the maximum speed limit at which vehicles may proceed on or along the roadways, streets, driveways and parking areas in the apartment house complex known as "Stone Gate Garden Apartments."

 

§ 222‑8. Stop intersection.

 

A.  The intersection of Peddler Hill Road with Tanager Road is hereby designated as a stop intersection, and a stop sign shall be erected on Tanager Road at its entrance to said intersection from the north.

B.  The intersection of Peddler Hill Road with a cul‑de‑sac west of Tanager Road, also known as Tanager Road, is hereby designated as a stop intersection, and a stop sign shall be erected on said cul‑de‑sac at its entrance to said intersection from the north.

 

§ 222‑9. Parking prohibited in designated locations.

 

The parking or vehicles is hereby prohibited in any of the following locations:

A.  On both sides of Stone Gate Road within the Stone Gate Garden Apartments complex.

B.  On both sides of Tanager Road within the Stone Gate Garden Apartments complex.

 

§ 222‑10. Removal of vehicles.

 

When any vehicle is parked or abandoned on any street or road within Stone Gate Garden Apartments complex where parking is prohibited, said vehicle may be removed and stored pursuant to Article II of this chapter.

 

ARTICLE IV

Commuter Parking Lot

§ 222‑11. Parking without permit. [Amended 7‑8‑1985 by L.L. No. 3‑19851

 

Any vehicle parked in the commuter parking lot at Museum Village in the Town of Blooming Grove without having a valid permit prominently displayed in the front or rear windshield so as to be visible for inspection from the driving aisle or parked in other than a space designated by pavement markings or in violation of any parking meter time limit between the hours of 6:00 a.m. and 6:00 p.m. prevailing time shall be illegally parked.

ARTICLE VII

Town Property

§ 222‑15. Central Garage.

 

The stopping, standing or parking of vehicles is prohibited in the parking area at the Town Highway Central Garage, except by designated officials or employees of the Town of Blooming Grove.

 

ARTICLE VIII

Penalties

§ 222‑16. Violations seemed traffic infractions.

 

It is a traffic infraction for any person to violate any of the provisions of this chapter unless such violation is by any other law declared to be a misdemeanor or felony.

§ 222‑17. Penalties for offenses.

Any violation of this chapter shall be punishable as follows:

 

A. For a first offense, by a fine of not more than $100 or imprisonment for not more than 15 days, or both.

 

B. For a second conviction within 18 months, by a fine of not more than $200 or imprisonment for not more than 45 days, or both.

 

C. For a third conviction within 18 months, by a fine of not more than $300 or imprisonment for not more than 90 days, or both.

 

ARTICLE IX

Miscellaneous

§ 222‑18. Adoption of regulations.

 

All vehicle, traffic and parking requirements and regulations shall be adopted by the Town Board in accordance with the provisions of the Vehicle and Traffic Law or by an officer or an agency authorized by the Town Board to adopt regulations pursuant to § 1603 of the Vehicle and Traffic Law. An requirements and regulations so adopted shall be included on a written schedule of regulations and shall be deemed a part of this chapter.
